State Supreme Court Blocks Smoking Ban

Lexington, KY – The Kentucky Supreme Court has stepped in to
stop enforcement of a smoking ban in Lexington.
Otherwise, a new smoking ban ordinance would
have taken effect at midnight.

Without comment, the Justices ordered a halt to
enforcement while an opposition group appeals
a trial judge's ruling that the ordinance is
constitutional.

The Justices also decided to settle that appeal
directly and ordered the Intermediate Court of
Appeals to transfer it. They set a hearing for
March tenth.

Earlier today the State Court of Appeals turned
down a request for an injunction.
